Terms of Service
No fluff. Just the terms that keep clients, collaborators and Elanix AI aligned.
These terms govern use of elanixai.com. Paid consulting, implementation and support work is also governed by the proposal, statement of work or order accepted for that engagement.
1. About Elanix AI
Elanix AI is operated by Elanix Holdings Pty Ltd and provides AI consulting, automation, systems implementation, training and related digital services.
2. Website use
You may use this website for lawful information and enquiry purposes. You must not interfere with its operation, attempt unauthorised access, submit harmful material or use content in a way that infringes rights.
3. Engagement scope
Project outcomes, deliverables, assumptions, client responsibilities, fees and timelines should be described in an accepted proposal or statement of work. A change that materially affects scope, integrations, data, volume or delivery may require a revised estimate and schedule.
4. Client responsibilities
Clients are responsible for providing accurate requirements, timely access, authorised data, appropriate decisions and testing feedback. Clients must have the right to use every account, dataset, brand asset and third-party service supplied for a project.
5. AI and automation limits
Automated and generative systems can produce incomplete or incorrect outputs. Unless expressly agreed otherwise, clients remain responsible for reviewing outputs and retaining human oversight over legal, financial, employment, safety or other consequential decisions.
6. Third-party services
Projects may depend on hosting, model, messaging, database, automation or software providers. Their availability, pricing and terms are outside Elanix AI's control. Material provider changes may require an adjustment to the system or engagement.
7. Fees and payment
Fees, billing milestones, taxes and payment dates are stated in the accepted order. Work may pause when an invoice is overdue. Recurring services continue until cancelled under the applicable order terms.
8. Intellectual property
Each party keeps ownership of material it owned before the engagement. Rights in custom deliverables, reusable components, third-party materials and licensed tools are determined by the accepted proposal and applicable licences. Elanix AI trademarks and site content may not be used without permission.
9. Confidentiality and data
Each party should protect confidential information and use it only for the engagement. Personal information is handled in line with the Privacy Policy and any project-specific data terms.
10. Warranties and liability
Services are delivered with reasonable care and skill. To the extent permitted by law, indirect or consequential losses are excluded, and aggregate liability is limited by the accepted engagement terms. Nothing here excludes a right or liability that cannot legally be excluded.
11. Ending an engagement
Cancellation, termination assistance, refunds and handover obligations are governed by the accepted order. Access to client-controlled systems should be removed or transferred as part of offboarding.
